YOU MUST READ AND AGREE TO ALL TERMS AND CONDITION BEFORE YOUR Registration can be approved to bid, buy, or sell on T.O. Global Wildlife Exchange. A copy of a valid Drivers License must be sent to TOGWE before selling or buying.

These Terms of Use together with our Privacy Policy, govern your access to and use of www.toglobalwildlifeexchange.com

 

THESE TERMS ARE A BINDING CONTRACT BETWEEN YOU (buyer/Seller) AND T.O. Global Wildlife Exchange LLC. (Also referred to as TOGWE) PLEASE READ THEM CAREFULLY. BY ACCESSING AND USING TOGWE, WHETHER AS A VISITOR, BIDDER OR SELLER, YOU CONFIRM YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS.

TOGWE acts as an agent only. Ownership and responsibility of each item changes hands at the closing of each successful listing from seller to buyer.  Removal shall be at the expense, liability and risk of the purchaser.  THE PURCHASER CERTIFIES THAT THEY WILL ASSUME LIABILITY FOR THE PAYMENT OF ANY TAX THAT MAY BE DUE FOR EACH TRANSACTION A user who is highest bidder agrees that they will be contractually obligated to pay for the listing and that the purchaser assumes all risk of loss or accident.    All sales as is, where it is. No guarantee against sickness, accident or death.

 

  • Accounts:  All Accounts must be registered with the name and address the checks will be made out to and mailed to.  Set a secondary address. name it mailing address. Enter info for who to make checks payable to and the address you would like it mailed to.  Set this address as primary and show on invoice.  If you need help please contact the office. 
  • Ownership and responsibility of each item changes hands at the closing of each successful listing from seller to buyer. TOGWE and facilities acts as an agent only. Removal shall be at the expense, liability, and risk of the purchaser.  All sales are as it where it is. We offer no warranty.
  • Quantity of Auction item. Pay attention to the quantity!   All auctions that have more than one animal,  the final bid will be multiplied by the quantity.  (Example: 0.2 axis and the final bid is $300.00 your total would be 300.00 X 2= $600.00. All sales are final.  It is your responsibility as bidder to pay attention to the Quantity.
  • Number system. Example: 1.2.3 Axis = 1 male. 2 female. 3 babies (Male.female.babies)
  • Compliance With Laws. You are responsible for, and agree to abide by, all local, state, federal laws, rules, and regulations applicable to your use of TOGWE.
    • Check with your respective state for requirements.
    • It is buyer’s responsibility to comply with their respective state rules and requirements
  • Consignors/seller must contact office to schedule a time to drop off animals.
  • Buyers must contact TOGWE by phone or email immediately following the close of the auction (WEDNESDAY 1Pm) to set up payment and schedule a time to pick up animals. Yardage feed will be applied to any animals not picked up by Friday at 5pm of that week. 
  • Payment for full amount owed must be made by check image (front and back pictures of check)  sent by email or text to 936-337-0614 or toglobalwildlifeexchange@gmail.com
    1. Made payable to T.O. Global Wildlife Exchange LLC.
    2. Full payment on all animals is due no later than 2pm the day the auction successfully closes. (Wednesday) 
    3. invoice # in memo
    4. Credit card used at registration is not kept on file and will NOT be used to make purchase.  It is only used in the verification process. We accept Checks or Bank transfers only. 
  • Commission rates:
    1.  0.01-$100.00 = $15.00
    2. $100.00 199.99 =15%
    3. $200.01-$4999.99= 10%
    4. $5000.00-over = 8%
    5. YOUR LOCATION RATE 7% (only for listing located at a different location than one of our facilities)
  • TOGWE will collect a commission, along with any other fees incurred by the seller, from the total winning bid amount before payment is made to the seller.
  • CONSIGNORS will be charged a Yardage fee. $2.00/daily per head 
  • A copy of a valid drivers license is  to be kept on file with TOGWE for every buyer and sellers.  please email a copy to toglobalwildlifeexchange@gmail.com or text a picture to 936-337-06140
  • Proxy bidding: when using proxy bidding the system will bid for you up to the amount you have entered. 
      • Proxy bidding on items with a reserve: Proxy bidding is not allowed on these items until the reserve price is met.
  • Snipe bidding is not allowed. If bid is placed in the last seconds of an auction the time of auction is extended by 15 seconds.
  • Delivery Available. We, TOGWE may provide a list of third-party providers or affiliates who provide hauling of animals, we will not be liable for any acts or omissions of any such third-parties or affiliates, whom you use at your own discretion and risk.
  •  All disputes that arise between bidders, TOGWE reserves the right to reopen bidding or designate a buyer.  TOGWE decision will be FINAL.
  • Placing a bid on this site, and winning, then not paying for the product is illegal, and prosecution will result.
  • To pickup animals a receipt needs to be shown to TOGWE employee as proof of purchase. 
  • We prefer a printed out copy but a screen shot will work as long as it shows all info.
  • We will not load an animal with out proof of payment.
  • ANY LISTING SOLD AT A LOCATION OTHER THAN HUNTSVILLE LIVESTOCK, PAYMENT WILL BE HELD TILL ALL ANIMALS HAVE BEEN DELIVERED/PICKED UP.  CONSIGNOR SETS THE TIME FRAME FOR PICKUP. 
  • All paperwork (travel papers, scrapie tags, health paper etc.) must be together on all animals BEFORE arriving at TOGWE to drop off animals. We will not unload animals till all paperwork is present and in order. (Check with respective state for requirements)
  • Tampering with www.toglobalwildlifeexchange.com in anyway is strictly forbidden.

 

  1. Access and Use. Use of T.O. Global Wildlife Exchange, LLC, www.toglobalwildlifeexchange.com as a bidder or seller is a binding contract with us, in compliance with these Terms and all applicable local, state, national,  rules and regulations. Any use of TOGWE by anyone under the age of 18 is strictly prohibited. TOGWE is not available to any users we have previously removed or suspended from our site. We may suspend or terminate your access to our TOGWE at any time, for any reason (such as your material breach of these Terms, our reasonable belief that it is necessary to protect the safety or property of others, to prevent fraud or for risk assessment purposes) or for no reason. We reserve the right to limit your use of our TOGWE or terminate your account immediately, without notice or refund of any amounts that you may have paid to us.
  2. Account. .If you use TOGWE as a Bidder or Seller you must be registered with us, and you will be assigned to a user account. By registering with us and/or using TOGWE as a Bidder or Seller, you represent and warrant that you.
    1.  will abide by all the terms set forth herein.
    2.  will not register for more than one account.
    3.  will not provide false or misleading information about yourself or the items.
    4.  will maintain the security of any user identification code and/or password associated with your account, notify us immediately if you suspect that such security has been breached, and accept all risks of authorized and unauthorized access to your account and the information you provide to us.
    5. While we use reasonable efforts to provide TOGWE to you for so long as you are compliant with these Terms, we do not guarantee that they will be secure, or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platforms to access or use TOGWE. You should use your own virus protection software.          
    6. If you register or use TOGWE on behalf of a third party (such as another person or legal entity), then you represent and warrant that you are an authorized representative of that person or entity with the authority to bind such person or entity to these Terms, and you agree to these Terms on behalf of that person or entity.
    7. Accounts are non-transferable. Only you may use your user account. You are liable for all activities that are undertaken using your user account. We may verify your registration and account by collecting contact information (including, but not limited to, legal company name, street address, and employer identification number) and banking information from you, directly calling you to confirm the accuracy of your account information and taking whatever additional steps we deem necessary.
    8. Credit card used at registration is not kept on file and will NOT be used to make purchase.  It is only used in the verification process. We accept Checks or Bank transfers only.

  3. Prohibited Uses.  TOGWE, prohibits the following action. TOGWE also will impose a penalty fee of at least if not more than $500.00 for each prohibited action and member will be permanently banned from TOGWE.  Buyers, Sellers, and visitors to TOGWE must not:
    1. modify or alter any Auction Information, content, materials, or portions of www.toglobalwildlifeexchange.com
    2. use any Auction Information, illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text, or any text separately from any accompanying illustrations, photographs, video or audio sequences or any graphics;
    3. remove any indications of ownership from any Auction Information or content which came from www.toglobalwildlifeexchange.com, or claim it as your own or as that of any other entity or individual.
    4. access, or attempt to access, parts of www.toglobalwildlifeexchange.com that are not intended for public use (including but not limited to website administration areas);
    5. conduct any web scraping, web harvesting, web data extraction, or any other data scraping of Auction Information or www.toglobalwildlifeexchange.com
    6. use any robot, spider, scraper, data mining tool, data gathering tools, data extraction tools, or any other automated means to access TOGWE, or collect, copy, or record our Auction Information or content off TOGWE.
    7. take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
    8. copy, download, distribute, transmit, reuse, report, reproduce, modify, use, create derivative works from, or publicly display any Auction Information or content of TOGWE, including the text, images, audio, and video, for public or commercial purposes, including generating any reports or aggregating any data or content.
    9. extract reports from TOGWE other than records relating to your auction or bid history.
    10. use our Auction Information or our Services for benchmarking or competitive analysis of our Services;
    11. identify us or display any portion of our Auction Information, TOGWE on any site or service that disparages TOGWE, or infringes any of our intellectual property or other rights
    12. bypass any measures we may use to prevent or restrict access to TOGWE.
    13. attempt to disrupt or interfere with the Auction Information or  www.toglobalwildlifeexchange.com  in any way or with another user’s/visitor’s use of TOGWE or use the Auction Information or TOGWE as a means of disrupting or interfering with other websites or networks.
    14. probe, scan, or test for vulnerabilities of TOGWE, other websites, or any networks connected to them;
    15. willfully corrupt any Auction Information, data, documents, or content available through TOGWE;
    16. knowingly or recklessly transmit or distribute a virus into our network and computer systems; or
    17. assist, encourage or permit any other person to do any of the acts described above.
    18.  Interference is considered to be discussions of any kind not pertaining to a current listing or trying to manipulate in any way a listings closing, or side deals of any kind. If a TOGWE user interferes with a listing that is not theirs in any way, they will be banned from the auction site and fined $500.00 for each listing a user interfered with.
    19. Placing a bid on this site, and winning, then not paying for the product is illegal, and prosecution will result.
    20. Snipe bidding is not allowed. If bid is placed in the last seconds of an auction the time of auction is extended by 15 second.
  4. Breach of Usage. All the prohibited uses set forth in these terms and conditions are forbidden regardless of the means used, including but not limited to, hacking or by the introduction of any worms, Trojan horses, viruses, unauthorized, malicious, or harmful code or other harmful software. By breaching this provision, you may be committing a criminal offence. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use TOGWE will cease immediately.
  5. Compliance With Laws. You are responsible for, and agree to abide by, all local, state, federal laws, rules, and regulations applicable to your use of TOGWE.
    1. Check with your respective state for requirements.
    2. It is buyer’s responsibility to comply with their respective state rules and requirements.
  6. Delivery Available. We, TOGWE may provide a list of third-party providers or affiliates who provide hauling of animals, we will not be liable for any acts or omissions of any such third-parties or affiliates, whom you use at your own discretion and risk. Your access to and use of our other websites and third-party or affiliate services may be subject to the applicable terms and conditions of that respective third-party or affiliate.
  7. Disclaimer; No Warranty. Ownership and responsibility of each item changes hands at the closing of each successful listing from seller to buyer. TOGWE acts as an agent only. Removal shall be at the expense, liability, and risk of the purchaser.  All sales are as it where it is. We offer no warranty.
  8.  Disputes Between Bidders. Any and all disputes that arise between bidders, TOGWE reserves the right to reopen bidding or designate a buyer.  TOGWE decision will be FINAL.
  9. Consignor/Seller.  As consignor/seller you agree to the following
    1. Enters a legally binding contract with TOGWE.
    2. Your account must be registered with and approved by us, in our sole discretion, before you can use TOGWE.
    3. He/She has the legal right to sell, all items listed for sale.

    5. You are solely responsible for any Listed Item(s) that you place for auction using TOGWE until the close of a successful auction.
    6. Consignor/Seller also agrees to not hold TOGWE responsible for an animal(s) that dies, becomes sick or injured before the close of an auction.
    7. You will not list any Item(s) through TOGWE that are illegal to use, possess, auction, or sell under any applicable law, rule, or regulation.
    8. to contact office to set up a time to drop off animals.
    9. Contact office when animals have been picked up, all checks will be held till the animal has been picked up. 
    10. that once a listing has started not to close or end the listing early, If a listing is ended early the consignor agrees to pay 10% or $100.00 (whichever is higher) of the highest bid for a PO fee for any auction item pulled from the auction before an auction has closed.
    11. TOGWE will collect a sellers fee, along with any other fees incurred by the seller, from the total winning bid amount before payment is made to the seller.
    12. To pay commission to TOGWE
      1. 0.01-$200.00 = $15-15% (whichever is higher)
      2. $200.01-$5000.00 = 10%
      3. Over $5000.00 = 8%
      4. your location listing rate 7% (only for listings located somewhere other than one of our facilities)
    13. To pay a Yardage fee.
      1. $2.00/daily per head
    14. If consignor sets a reserve on their auction item and the item does not meet their specified reserve, or seller buys back the animal, the Seller will owe TOGWE commission rate of the last bid on the animal and yardage fee.
    15. To have all paperwork (travel papers, scrapie tags, health paper etc.) together on all animals BEFORE arriving at TOGWE to drop off animals. We will not unload animals till all paperwork is present and in order. (Check with respective state for requirements)
    16. ANY LISTING SOLD AT A LOCATION OTHER THAN HUNTSVILLE LIVESTOCK, PAYMENT WILL BE HELD TILL ALL ANIMALS HAVE BEEN DELIVERED/PICKEDUP.  CONSIGNOR SETS THE TIME FRAME FOR PICKUP.

  10. Buyer. As a buyer you agree to the following
    1. Bidding on a item is a contractual agreement to the terms and conditions set forth by TOGWE.
    2. To contact TOGWE @936-337-0614 or toglobalwildlifeexchange@gmail.com  immediately following the close of the auction (WEDNESDAY 1Pm) to set up payment and schedule a time to pick up animals
    3. Agrees to call or email TOGWE to set up an appointment to pick up animals No later than 1pm the day the auction successfully closes. (Wednesday) Any animals not picked up by 5pm Friday will be charged a yardage fee (amount will vary depending on situation) 
    4. A copy of a valid drivers license is  to be kept on file with TOGWE for every buyer and sellers.  please email a copy to toglobalwildlifeexchange@gmail.com or text a picture to 936-337-06140
    5. Payment for full amount owed must be made by check image (front and back pictures of check)  sent by email or text to 936-337-0614 or toglobalwildlifeexchange@gmail.com

      2. All returned check will be forwarded to the Walker Co Attorney off for prosecution to the maximum extent permitted by law.
    6. Ownership and responsibility for death, injury, or sickness changes hands at the closing of a successful auction from seller to buyer.
    7.  It is the Buyer's responsibility to know their state's entry requirements before bidding on an item. 
    8. It is buyer responsible to ask for any paperwork that goes with an auction item. (Travel papers, health papers, etc.).
    9. Buyer is responsible for providing a receipt of purchase to TOGWE when picking up animals.  We prefer a printed out copy of the invoice, but screen shot will work also.
    10. The buyer of an item on TOGWE will be responsible for paying sales tax if applicable.
    11. Pay attention to the quantity!   All auctions that have more than one animal,  the final bid will be multiplied by the quantity.  (Example: 0.2 axis and the final bid is $300.00 your total would be 300.00 X 2= $600.00. All sales are final.  It is your responsibility as bidder to pay attention to the Quantity.

    14. if buyer fails to make payment, or the method of payment is declined there will be a penalty fee of  $300.00 plus the commission price that was owed on the defaulted listing.  TOGWE reserves the right to take civil action on any outstanding fees and penalties.

  11. Bidding. Bidding is a binding contract between TOGWE and bidder.

    3. Proxy bidding on items with a reserve: Proxy bidding is not allowed on these items until the reserve price is met.
    4. Placing a bid on this site, and winning, then not paying for the product is illegal, and prosecution will result.
      1. if buyer fails to make payment, or the method of payment is declined there will be a penalty fee of  $300.00 plus the commission rate that was owed on the defaulted listing.  TOGWE reserves the right to take civil action on any outstanding fees and penalties.
  12. Payment and Billing.

    2. TOGWE will send the highest bidder a conformation email at the close of a successful sale with Final amount owed. 
    3. TOGWE will collect a sellers fee, along with any other fees incurred by the seller, from the total winning bid amount before payment is made to the seller.
    4. All Consignors must contact the office once the animal has been picked up and your check will be mailed.
